Land Use Controls Regarding Vapor Intrusion

Hangar hearing Tuesday

A plan covering future uses of a former Air Force hangar complex at Griffiss will be considered at a public hearing Tuesday at 5 p.m. at the Griffiss Institute, 725 Daedalian Drive. 

The building is currently occupied by Premier Aviation Overhaul Center and the Air Force Research Laboratory. Aircraft rehabber Premier uses three of the hangars and shop and office space. Rome Lab uses the fourth hangar. 

The structure is still owned by the Air Force, but the sections not used by Rome Lab are under a lease with 394 Hangar Road Corp. The 394 group is Premier's landlord. 

Going forward, the Air Force is proposing land-use controls: 

-- Development for residential housing, elementary and secondary schools, child care facilities, and playgrounds will be prohibited. 

-- Owner or occupant of the structure will evaluate the potential for soil vapor intrusion if future new construction is performed in a restricted area. 

The Air Force plan is a result of the three separate issues: a former 12,000-gallon underground storage tank, a former battery acid disposal pit and a former battery acid drainage pit. 

A copy of the proposal is available at the Griffiss location of the Air Force Center for Engineering and the Environment, 428 Phoenix Drive. Public comments are being accepted through Sept. 14. 

The Air Force is in the midst of an ongoing process to turn over title to sections of Griffiss to local control. The hangar complex, known as Building 101, is now on the list for action.

NC Brownfields - Ready-for-Reuse Agreement Program

For sites that may have undergone obtaining a brownfields agreement and been denied, or did not enter the program due to use of chemicals of concern by current occupants, the North Carolina Brownfields Program has developed a new approach where a draft brownfields agreement is prepared with the prospective developer listed in the agreement as “to be determined.” The “Ready-for-Reuse Brownfields Agreement” allows a prospective buyer to purchase a site that has a draft brownfields agreement prepared in advance. 

There are still issues to be addressed, depending upon the purchaser’s end use, but the concept is to promote marketing and redevelopment of contaminated sites with CERCLA liability protections. More info is available at the following link - NCDENR - Brownfields Program
